Prosecuter­s back off on sex assault charge

An off-duty MTA train conductor arrested for sexually assaulting a woman was released from police custody pending further investigat­ion from the Queen’s district attorney, authoritie­s said Sunday.

Nathaniel Mayo, 31, was taken into custody Saturday morning in Queens for sexually assaulting a woman, police said.

But on Sunday, prosecutor­s said they were deferring prosecutio­n.

Mayo’s victim claims the couple began having consensual sex when Mayo forced her into anal sex, sources said.

Police charged Mayo with committing a criminal sex act, assault and harassment.

But Queens prosecutor­s said they need more time to build the case.

After the woman tried to stop Mayo multiple times, the couple got into an argument and the train conductor slapped the woman and twisted her arm, according to cops.

An MTA spokesman said on Saturday that Mayo had been pulled from service “pending a meeting with labor relations.”
