Finer points
Brentwood, L.I.: I found Voicer Chana Schwartz’s excellent letter very informative. I did note that there was one misstatement and an omission. There is no mention of censure in Article I, Section
3 of the Constitution, where what can be done to a president after a conviction is outlined. Only removal from office and disqualification to hold office is authorized. To censure a president, the Senate would have to take that up as a separate action outside of the impeachment trial. Schwartz failed to mention that the Constitution requires that the chief justice preside when the president is on trial. In this second trial of President Trump, Chief Justice John Roberts did not preside. For that reason, I feel this trial was unconstitutional. I’m surprised that the Supreme Court did not comment on the question of having someone other than the chief justice preside.
