NOTICE OF PUBLIC FORECLOSURE SALE OF COOPERATIVE APARTMENT
TERMS: Such sale shall be subject to the terms and conditions set forth in the Terms of the Sale. The Apartment is to be sold “As Is.” The Terms of Sale may be obtained from the undersigned, the attorneys for the Secured Party. The sale is also subject to the approval of Island House Tenants Corp, payment of all sums due, if any, to the cooperative corporation; any existing tenancy; payment of all expenses and attorney’s fees of Secured Party and expenses of sale and auctioneer’s fees. A ten percent (10%) deposit will be required to be paid to “Falcon Rappaport & Berkman LLP as escrow agent” at the auction with the successful bid. The balance of the bid price is due within 30 days, and no later than January 19, 2024. Time is of the essence. The deposit and the balance of the bid price are payable by unendorsed certified, or cashier’s check drawn upon a member bank of the New York Clearing House. The sale is not contingent on financing.
The sum due Secured Party now exceeds $430,000.00, excluding costs, attorney’s fees and other unpaid maintenance and related fees and expenses.
The Secured Party, for itself and for its nominee (s), designee(s) or assignee(s), reserves the right to bid, to become the purchaser at the sale, and, without deposit, to credit against the purchase price bid all sums due to it under said security agreement and note, and to adjourn, delay or terminate the sale by announcement at the sale without further publication or notice. The Secured Party further reserves the right to reject any and all bids less than the amount due the Secured Party.
The Secured Party makes no warranties or representations. Each bidder will have to make his or her own inquiry regarding the Apartment and any liens or debts in connection therewith.
