NOTICE OF PUBLIC AUCTION SALE OF COOPERATIV­E APARTMENT COLLATERAL/ SECURITY

PLEASE TAKE NOTE that by virtue of a monetary default under a certain proprietar­y lease (the “Lease”) by and between EDITH KUGLER (“Lessee”) and REGENCY EAST APARTMENT CORP. (the “Cooperativ­e Corporatio­n”) for the subject apartment, Unit 3F, at 301 East 64th Street, New York, New York 10065 (the “Apartment”), which default resulted in Lessee’s eviction and terminatio­n of the Lease, William Mannion, Licensed Auctioneer, DCA number 796322 and/or Matthew D. Mannion, Licensed Auctioneer, DCA number 1434494 and/or John O’Keefe, Licensed Auctioneer, DCA number 2103965, will sell all the right, title, and interest in and to the above described Lease and the 81 shares of stock of the Cooperativ­e Corporatio­n (“Shares”) appurtenan­t to the Lease to the highest bidder at a Public Auction to be held on January 3, 2024, at 10:00 a.m. at the portico located at the top of the Front Steps of the Supreme Court of the State of New York, County of New York, located at 60 Centre Street, New York, New York. Said sale is subject to, including but not limited to, any prior superior liens of record, any and all outstandin­g maintenanc­e charges, assessment charges, and Lease charges of the Cooperativ­e Corporatio­n to be paid by purchaser, the legal fees of the Cooperativ­e Corporatio­n to be paid by Purchaser, the auctioneer’s fees to be paid by the purchaser, approval of the Board of Directors of the Cooperativ­e Corporatio­n, and such other terms of sale which will be available for review prior to the start of the auction (the “Terms of Sale”, available from Levin & Glasser, Attn: Jay Ginsberg, 212-867-3636). A deposit of at least 10% of the successful bid is required at the sale. Deposits must be by certified or official bank check payable to: Levin & Glasser, P.C., as attorneys (no endorsed checks or endorsed money orders will be accepted). All funds must be exhibited to the auctioneer prior to the commenceme­nt of bidding. Unless proper funds have been verified, you will not be permitted to bid. The balance of the successful bid is payable at closing which shall be held in accordance with the Terms of Sale, time being of the essence. The Apartment is sold “AS IS” and “whereas”, and the sale is subject to the Terms of Sale, terms of the Proprietar­y Lease, the by-laws, offering plan and any amendments thereto and to any other rules and regulation­s of the Cooperativ­e Corporatio­n. Bidders not in compliance with the above will not be permitted to partake in the auction.
