For much of the last five years of the affair, Speer used a wheelchair and was in a “significant diminished mental capacity,” the widow’s lawyers assert.
The accusations have sent shock waves through Morgan Stanley, which appeared to take down Forte’s Morgan Stanley adviser Web site less than an hour after being contacted by The Post.
Forte is a wellknown presence at the bank. She joined the firm in 2000, and has been a member of the bank’s Chairman’s Club since 2001. She was named Barron’s top woman financial adviser in 2012 and 2013 — managing more than $2 billion in assets.
But Forte, 57, also had a “a close, intimate relationship” with Speer, and those allegedly unauthorized trades violated Florida’s Elder Exploitation Statute and Florida’s Investor Protection Act, according to a statement from Guy M. Burns, a lawyer for Speer’s widow, Lynnda.
The bank’s code of conduct does not explicitly state romantic relations between its advisers and their clients run afoul of the bank’s rules, according to its 2015 policy on its Web site.
“Avoid any investment, activity or relationship that could, or could appear to, impair your judgment or interfere with your responsibilities on behalf of Morgan Stanley, our clients and our shareholders,” states the company’s policy.
When asked for a clarification, Jim Wiggins, a bank spokesman, refused to answer questions about the policy, telling The Post, “I’m not going to address it.”
Wiggins said he preferred to talk about the accusations against the bank. “We’re saying that that’s a bunch of bullst,” he added.
Attempts to reach Forte were unsuccessful.
