Can-cam suit
A hotheaded smallbusiness exec who was an inspiration for the film “Boiler Room” was caught on video screaming at an employee to “Get the f k out of my firm!” as he fired him in front of coworkers and accused him of stealing from the company.
Now the two sides are headed to trial in Manhattan in the yearslong legal dispute with the cringeworthy video at the center of a defamation counterclaim by the canned employee.
David Glass, cofounder of merchant cashadvance firm Yellowstone Capital, unceremoniously fired Gregory Stern on Jan. 17, 2012, claiming he cost the company at least $600,000 by taking kickbacks from clients, a Manhattan Supreme Court lawsuit says.
In the cellphone video, which was posted to YouTube the day Stern was fired, Glass focuses his rage on Stern in front of other stunned employees at a staff meeting.
“When somebody steals from Yellowstone Capital, they hurt all of us. When they embezzle from the company, we all lose, be cause we try to price every deal here . . . as aggressively as possible,” Glass says, his voice still calm.
But he quickly ramps it up, saying, “Greg Stern, get out,” before shouting, “Get the f k out of my firm!”
“Get out or I’ll call the cops! Why are you still sitting there, fat ass? Get out of my company!”
When Stern tries to state his case, Glass interrupts: “No. You can get the f k out. Get a lawyer.”
Glass was busted in 2007 for insider trading. He got probation and went on to found Yellowstone, based in the Financial District.
His rise and fall at daytrading firm Jasper Capital was depicted by Giovanni Ribisi in the 2000 film “Boiler Room” in which young hotshot brokers unload risky stocks on unsuspecting investors.
Yellowstone sued Stern for breach of contract, accusing him and his thengirlfriend, Nigina Khasidova, of running an “unlawful kickback scheme,” court papers say.
Stern countersued for defamation, saying two colleagues posted videos of his humiliating termination online at the behest of Glass.
