Oops, I trashed 864G in diamonds

A fistful of diamonds worth nearly $1 million was accidental­ly thrown out with the trash in Manhattan’s Diamond District, a new lawsuit says.

“I’m upset myself about how stupid I am,” said Bobby Yashaya, the owner of Max Jewelry at 23 W. 47th St., who is now suing his insurance company over the monumental loss.

The trouble began as he was rushing around one Friday night before the Jewish Sabbath in May 2015 preparing for a trade show in Las Vegas, Yashaya said.

He said he bundled four single 8- to 12-carat diamonds and a pair of diamond earrings in white paper pouches secured by a rubber band. The stones were worth a combined $864,100.

As he was rushing to leave, the building’s maintenanc­e man came to collect the trash. The preoccupie­d jeweler had papers and napkins on a countertop next to the bundled gems and unknowingl­y brushed the whole pile into the garbage can, he said.

At the Las Vegas convention five days later, he realized his million-dollar mistake, Yashaya said.

“I didn’t sleep. I was praying. I was praying that they would be found. My heart fell, and I couldn’t work,” Yashaya recalled.

He said he asked his wife, Jenia, to rush to his Diamond District store to scour the building’s garbage, but it was hopeless.

“I felt like crying,” Yashaya said. “There’s millions of tons of garbage. My diamonds were some- place, [but the landlord said] they could be in Staten Island, they could be in New Jersey.’’

Yashaya has filed suit against Lloyd’s of London to try to recoup his losses.

The jeweler admits he didn’t have original receipts for the gems, but claims he provided Lloyd’s with other documents from the transactio­ns.

But Lloyd’s agent was “hostile” with him, even threatenin­g to “send [him] to multiple lie-detector tests regarding the loss,” the owner said in court papers.

Yashaya’s lawyer, Matthew Marks, said Lloyd’s settled for two days of testimony under oath about the diamonds.

Yet Lloyd’s has not compensate­d Yashaya and has canceled his policy, leaving his business “paralyzed,” court documents say.

“I did everything I was supposed to have done,” Yashaya said about filing his claim. “This is an accident. This is why we have insurance, for accidents.”

A Lloyd’s rep declined to comment on the pending litigation.
