Now concedes Kav ‘vic’ doesn’t recall ‘incident’

The New York Times had to issue an embarrassing correction to its story about another decades-old accusation of sexual misconduct against US Supreme Court Justice Brett Kavanaugh — because it failed to tell readers that the alleged victim doesn’t even remember the incident.

As The Post reported in its frontpage story Monday, the Times piece omitted that crucial fact.

The Times article was adapted from a book on Kavanaugh by two of its reporters, Robin Pogrebin and Kate Kelly. The newspaper claimed that Max Stier, a former classmate of the future justice years ago at Yale University, had allegedly seen Kavanaugh pull his pants down at a party and friends then push his penis into the hands of a female student.

The Times report said that while Stier “has declined to discuss [the incident] publicly,” the newspaper “corroborated the story with two officials who have communicated with Mr. Stier.”

Oddly, while the book about Kavanaugh noted that the woman Stier was talking about doesn’t recall the incident, the article left that detail out.

In its correction late Sunday, the newspaper said, “The book reports that the female student declined to be interviewed and friends say that she does not recall the incident. That information has been added to the article.”

The corrected article still failed to mention something The Post pointed out Monday: that Stier “appears to be the same Max Stier who was on then-President Bill Clinton’s legal team during the Lewinsky scandal in 1998.’’

The Times also didn’t note that Stier worked on Clinton’s defense team during the Whitewater investigation in the 1990s that was run by independent counsel Ken Starr. Kavanaugh worked for Starr at the time.

A Times spokeswoman said no one was available for an interview on Monday.

The Times’ deputy editorialpage editor, James Dao, posted answers to readers’ question on the newspaper’s Web site Monday evening but did not address this issue.

Republicans quickly jumped on all the troublesome issues with the article.

“The New York Times walks back report on Kavanaugh assault claim,” President Trump said in the first of two tweets about the correction.

“The one who is actually being assaulted is Justice Kavanaugh – Assaulted by lies and Fake News! This is all about the LameStream Media working with their partner, the Dems.”

In the other tweet, Trump wrote, “I call for the Resignation of everybody at The New York Times involved in the Kavanaugh SMEAR story, and while you’re at it, the Russian Witch Hunt Hoax, which is just as phony! They’ve taken the Old Grey Lady and broken her down, destroyed her virtue and ruined her reputation.”

Trump also said Kavanaugh should sue.

But leading Democrats, including some presidential contenders, pointed to the Times story as proof Kavanaugh never should have been confirmed — and said he should now be booted from the esteemed post.

“He was put on the Court through a sham process and his place on the Court is an insult to the pursuit of truth and justice. He must be impeached,’’ Sen. Kamala Harris (D-Calif.) tweeted.
