Buffett firm legal target GM truck tailgate recall

- Shannon Thaler

The lawyers who won a historic verdict against the National Association of Realtors and brokerage firms are turning to a new target as part of their antitrust litigation: Warren Buffett.

On Monday, they named a large subsidiary of Buffett’s Berkshire Hathaway as a defendant in one of their lawsuits.

In October, plaintiffs won a $1.8 billion verdict after alleging that the

NAR and two brokerages used a commission structure that kept fees for Missouri agents artificially high.

One of those brokerages was HomeServices of America, which is owned by Berkshire Hathaway Energy. The new filing, which is part of a national lawsuit against the NAR and a handful of brokerages, won’t directly affect the case that went to trial last year.

General Motors is recalling nearly 820,000 pickup trucks over a faulty electronic latch mechanism used to open the trucks’ tailgates, increasing the risk of road hazards and crashes.

GM said in a safety-recall notice that affected vehicles include 570,434 Chevy Silverados and GMC Sierras with model years between 2020 and 2024 in the US, while an additional 249,000 were sold in Canada.

All of the gates on the affected trucks’ beds may short-circuit if water gets into the electric tailgate, GM warned, meaning the hinged door could inadvertently fall open and unsecured cargo in the bed may exit the vehicle “if the driver does not manually close the gate before beginning to drive.”

GM’s safety notice said it received 136 complaints of the tailgate opening “while driving,” although the gate is only intended to open when the vehicle is parked.
