Town Council set to again tackle ordinance on interim housing

The Paradise Town Council on Tuesday night will vote on how it will address the Interim Housing Ordinance that it discussed in August.

The council will be asked to pass an interim housing urgency ordinance with amendments that would extend the ordinance’s deadline to April 30, 2023; remove all alternativ­e thresholds of compliance, allow all issued temporary use permits, with no active code violations by Sept 30, 2021, to be extended until April 2023.

It would also add language regarding temporary use permit revocation when two or more violation notices are issued within a calendar year or two or more citations are issued on a single code violation.

The new ordinance would also create an exceptions committee comprised of two Town Council members.

Currently, the town said there are 288 temporary use permits (TUPs) that will potentiall­y be positively impacted by the proposed ordinance amendments.

Of that number staff noted that 18 were already working toward rebuilding by either working with the Town’s Housing Division or had signed contracts with builders.

According to staff, any extension issued by the council will also benefit them as their deadline for having a rebuild permit issued is currently set for Dec. 31, 2021.

The rest of the 270 TUPs are set to expire on Sept. 30, 2021.

In that number, the staff notes there are 22 sites currently violating one or more provisions of the urgency ordinance and won’t get the April 2023 extension unless they comply by the end of this month.

The town said those sites have been issued at least one Notice of Violation, at a minimum, while almost half have been cited.

Staff said that three most common violations are not being connected to a functionin­g septic system, not being connected to electrical service (still using generators), and having too many RVs on-site.

If the town adopts the new ordinance amendments as proposed, staff said that those 22 sites could get moved into abatement if not brought into compliance by Sept. 30.
