Planners table two requests

Planners held to their commitment to not approve plans with contingenc­ies as they tabled a preliminar­y plat for Elkhorn Ridge Phase III presented by Franklin Miller as the State Health Department approval has not been received by the city.

“We’ve been after this for six to eight months now,” Miller said to planners.

City inspector Tony Townsend said the city was waiting on drainage easements which have been signed and recorded.

Street Department superinten­dent Nathan See said the city has no jurisdicti­on over the project until the plan is approved.

Mike Nida, utilities director for the Water Department, said his department is waiting for the Health Department approval.

“I believe we’re waiting for the engineers to submit,” he said.

Planners voted unanimousl­y to table the plan.

Jim Brown presented a request to replat and rename Hillcrest Subdivisio­n.

An attorney, Jenna Fogleman with Keith, Miller, Butler, Schneider & Pawlik, requested the Planning Commission wait on the request as she represents a client who owns land adjacent to the subdivisio­n and has an access easement dispute.

“I think it can be resolved,” Fogleman said. “If it (the plan) is approved, he would be land locked.”

Townsend said, “Isn’t there an easement up off Sugar Creek?”

“No, that’s two private properties,” Fogleman said.

Brown said it doesn’t matter how the judge rules, that the plan was still acceptable.

“In light of this new informatio­n,” planner Al Fowler said, “I move that we table.” All planners agreed.

In other business, planners:

• Approved a conditiona­l use beer and wine sales permit for Fred’s, 198 N. Curtis Ave.;

• Approved rezoning 1.71 acres on Clark Street from agricultur­e to residentia­l;

• Approved a preliminar­y plat for Cardiff Manor; and

• Set a special meeting for Thursday, May 3, to discuss requests from Rob Miller, RLP Developmen­t.
