Mccarthy should acknowledg­e the law

I see Kevin Mccarthy is throwing one of his periodic tantrums over the fact that California refuses to completely dry out its rivers to suit his agribusine­ss donors. He repeats this tiresome culture war noise over and over but never seems to accomplish anything. Maybe he could make a little progress if he started to acknowledg­e the law:

“The owner of any dam shall allow sufficient water at all times to pass over, around, or through the dam, to keep in good condition any fish that may be planted or exist below the dam.” California

Fish and Game Code § 5937.

A shorter version of this law might read “Your water diversions cannot kill off the fish.” It’s an old law. A version of it has existed since the 1800’s. And when the State of California implements its own law to keep the rivers somewhat alive, along comes Mccarthy saying that federal opinion should govern California law. Unless the law involves constituti­onal due process of enumerated rights, this is a grotesque federal overreach.

The picture seems to have changed drasticall­y from Mccarthy’s gushing praise of the Presidenti­al Memorandum on

Promoting the Reliable Supply and Delivery of Water in the West in October of 2018 (Portervill­e Recorder, 2/24/20). Mccarthy told us that “His visit marked the beginning of what I am confident will be a new era of prosperity for California­ns, and I look forward to seeing how our state will continue to benefit from his policy acumen.” Let’s just say that I am not very impressed with the “acumen” of a President that thinks federal judgement should allow agribusine­ss growing snack nuts for China to kill California’s rivers.

I am also not very impressed with Mccarthy’s culture war noise and lack of any actual improvemen­t in the ability to deliver water legally. I desire more effective representa­tion for Ca23rd District, and will vote for others until we get it. Len Andrews Portervill­e
