Bond review hearing set for East Chicago man charged with rape

An East Chicago man will likely face a hearing this week on whether to revoke his bond from pending cases after he was charged with rape while out on an attempted murder case, court records show.

Darion R. Carter, 47, was charged April 22 with rape, criminal confinemen­t, battery and intimidati­on.

He is in custody, ordered to initially be held without bail.

Prosecutor­s filed a request to revoke bond on May 10. His bond review hearing is set for May 24 before Judge Natalie Bokota.

Court filings indicate prosecutor­s plan to file a habitual offender enhancemen­t in Carter’s rape case which could add between 5 and 20 years if convicted.

A woman told police she was at a friend’s house on April 21 in East Chicago when Carter threw rocks at the window to get his attention.

At 11:30 p.m., the woman left through the back door trying to avoid Carter. She felt a man grab her backpack from behind, throwing it on the ground, pinned her against the wall and raped her, charges state.

She told him she would go to the hospital and call the police.

“If you get the police involved, I will kill you,” he responded, according to court records.

At the time, Carter was out on bond on an attempted murder case, accused of attacking a family friend on Sept. 15 , allegedly stabbing, choking and preventing her from leaving his basement apartment for 12 hours, according to an affidavit.

“Do you know who I am? Do you know my family and (Lake County Prosecutor) Bernard Carter is my family,” he said, according to the affidavit. “Nothing (sic) going to happen to me. I’m not going to do a day in jail.”

He is charged with attempted murder, two counts each of criminal confinemen­t; aggravated battery, robbery, battery by means of a deadly weapon, battery resulting in serious bodily injury, strangulat­ion and kidnapping.

Carter is represente­d in both cases by defense lawyer Kerry Connor. He indicated in court records he may try to hire a private counsel.

Porter County Deputy Prosecutin­g Attorney Armando Salinas was appointed to step in on Carter’s attempted murder case. Bokota also granted a motion to appoint a special prosecutor in the rape case on May 3.
