Judge dis­misses suit over wa­ter bid

Firm had al­leged wrong­do­ing when it was not awarded pipeline con­tract

A judge dis­missed claims filed against the San An­to­nio Wa­ter Sys­tem by a con­struc­tion com­pany that al­leged wrong­do­ing when it did not get a pipeline con­tract.

Dis­trict Judge Larry Noll signed the or­der, end­ing the law­suit in fa­vor of SAWS and the city of San An­to­nio.

The law­suit, filed last month by a joint ven­ture of Os­car Renda Con­tract­ing and South­land Con­tract­ing, ac­cused SAWS and the city of ir­reg­u­lar­i­ties in a sealed com­pet­i­tive bid process for con­struc­tion of a nearly 2-mile pipeline in the Stone Oak area.

On Sept. 11, the SAWS board voted to award the con­tract to Guy F. Atkin­son Con­struc­tion, which sub­mit­ted a bid of just over $48 mil­lion. Renda/South­land had the low­est of five bids, at $31.4 mil­lion, and scored sec­ond in an eval­u­a­tion.

The pipeline is part of the mas­sive Vista Ridge wa­ter sup­ply project. It will con­nect to 15 miles of new and ex­ist­ing mains to dis­trib­ute wa­ter pumped from the Car­rizo Wil­cox Aquifer in Burleson and Milam coun­ties and car­ried through a 142-mile pipeline.

SAWS Pres­i­dent and CEO Robert Puente said Fri­day that SAWS ar­gued that “there were no is­sues there that gave the court the right to in­ter­vene in the con­tract” with Atkin­son. He did not know if Renda/South­land would file an ap­peal.
