Special counsel the right call
We have entered uncharted political waters.
Former President Donald Trump, under federal criminal investigation for his handling of classified documents as well as his potential role in the Jan. 6, 2021, insurrection, is now seeking the presidency.
Since President Joe Biden also has indicated he will likely seek a second term, it’s paramount the investigations be overseen by an independent third party. Attorney General Merrick Garland was absolutely right in appointing a special counsel, experienced prosecutor Jack Smith, to oversee these investigations.
Garland cited “extraordinary circumstances” and the need to serve the public’s interest. It is extraordinary to see a former president under federal criminal investigation challenge the incumbent, which is why it’s crucial to place distance between the attorney general and the investigation.
This won’t matter to Trump, who characterized the investigations as a witch hunt. Nor will it likely matter to his most intense followers. But it should matter to the public as a whole, just as it should bolster faith in our institutions. Justice Department staff will continue to investigate, and Smith will ultimately make a recommendation to Garland on prosecution.
As for Trump, we heard no new ideas in his announcement and a familiar airing of grievances. Whether this still resonates with voters remains to be seen. But the appointment of a special counsel ensures these investigations continue on the highest ethical footing.
