A 20-year-old man has been accused of killing his ex-girlfriend’s boyfriend.

Gustavo Garrido Jr. was arrested Thursday on a murder charge in the death of Jonathan Martinez, 22.

Martinez was with his girlfriend Saturday when she started getting phone calls from a blocked number. He pushed her to answer the phone and eventually answered it himself.

It was Garrido, according to an arrest affidavit. Garrido and the woman broke up in July, she told police.

The woman later talked to Garrido, and he told her he was coming to the apartment to kill her and

Martinez, the affidavit states. She urged Martinez to leave, but he refused for her safety. When Garrido got near, he called to say he was outside, and the woman told police she could hear his truck coming down the street. She said she saw him park outside the apartment complex, jump the fence and walk toward her apartment.

He had his hand in his waistband and appeared to have a gun, she later told police.

He was holding a gun when he came into the apartment “without her consent,” according to the affidavit.

“Who’s in here? I’m going to kill him,” Garrido reportedly said.

She tried to prevent him from entering the bedroom where Martinez was hiding, but he pushed past her, the affidavit states. Martinez said, “What’s up?” as he walked into the living room, and the woman told police Garrido pushed her to the floor before following Martinez.

She heard three gunshots. Then, she saw Garrido running away. Martinez had a gun in his waistband, and evidence at the scene indicates he fired his weapon during the incident, though his girlfriend said she didn’t see him pull it out.
