Biker charged with firing shots into home, barely missing 2 kids
A reputed member of the Hells Angels motorcycle club has been indicted on felony charges accusing him of firing shots that narrowly missed two children inside a Daly City home, a San Mateo County prosecutor said Tuesday.
Investigators believe Dionicio Rafael Lopez, 24, mistakenly thought he was shooting into the house of a rival gang member.
He pleaded not guilty Monday in Superior Court in Redwood City to felony assault, as well as weapons and gang charges listed in a county grand jury indictment. He remains in jail on a no-bail hold.
Lopez fired two shots into the house on July 24, 2011, believing a member of the rival Wanted motorcycle gang lived there, said District Attorney Steve Wagstaffe.
But Lopez had the wrong house, and the bullets nearly hit two children, ages 6 and 9, Wagstaffe said. One of the shots hit a TV that the children were watching, ricocheted and lodged into a wall, the prosecutor said.
Officers found Lopez hiding in a nearby home, Wagstaffe said, adding that a gun was recovered.
Lopez’s attorney, Joe O’Sullivan, said Tuesday that he expects the charges to be dismissed.
“I believe them to be specious,” he said. “I know Mr. Lopez well. I don’t believe he could ever have committed the acts that are attributed to him.”
