Woman, 78, suspected in West Portal crash is released from custody

The driver suspected of barreling into a West Portal bus stop — killing three members of a family and severely injuring an infant — was released from police custody early Wednesday, her attorney told the Chronicle.

San Francisco Sheriff ’s Office jail records also show that Mary Fong Lau, 78, was no longer in police custody as of Wednesday. The San Francisco resident, who was booked in absentia just one day after the deadly crash on Saturday, had been in police custody at the hospital, records show.

As of Wednesday, Lau was no longer in police custody but remained hospitaliz­ed, her attorney Sam Geller said.

Lau was booked into police custody Sunday on suspicion of multiple charges — including felony vehicular manslaught­er — but as of Wednesday had not been charged by the San Francisco District Attorney’s Office, spokespers­ons said.

San Francisco District Attorney Brooke Jenkins said Monday that her office was receiving and reviewing case informatio­n and evidence from police. Jenkins added that her office was also awaiting toxicology results and a review of the vehicle’s operating systems.

Lau is suspected of driving her Mercedes sports utility vehicle onto a sidewalk and ramming into a bus stop around noon on Saturday. The SUV struck and killed 1-year-old Joaquin Ramos Pinto de Oliveira and his father, Diego Cardoso de Oliveira, 40. The third victim, Matilde Moncada Ramos Pinto, 38, died on Sunday.

Their 3-month-old infant remained hospitaliz­ed with life-threatenin­g injuries.

The Brazilian-Portuguese family lived in the Mission District.
