Townsend man charged with lewdness

LUNENBURG » After a woman saw a man touching himself in a sexual manner in the parking lot of the Lunenburg Walmart in October, she wrote down the li

cense plate of the Jeep the man was driving and reported it to police, who summonsed the suspect to court for a hearing on Tuesday in Fitchburg on a single charge of open and gross lewdness, according to police and court documents.

This summons to appear in district court for an open and gross lewdness charge was the second time in seven months for Thomas A. Dwyer, 33, of 407 Main St., West Townsend.

He formerly lived on Florence Street in Leominster.

On Oct. 17, a 50-year-old woman re

ported to Lunenburg police that when she left her car to shop at the Walmart at about 10 p.m. there were no cars parked near hers but that when she came back a white Jeep Patriot was pulled so close to her car, she could not fit between them, the victim told police.

As she was putting items in her car, she saw a man who she later learned was Dwyer touching himself in a sexual manner with his pants pulled down to his knees, she told police.

Officers from Lunenburg and West Townsend were sent to Dwyer’s address to question him about his whereabout­s earlier and he, at first, denied he had been at the Walmart before finally saying he had and would tell his parole officer, which he did, adding that he needs help,

police reported.

When arraigned on Monday, Dwyer was released on personal recognizan­ce, according to court documents.

Dwyer still has an open case out of Leominster District Court for a charge of open and gross lewdness and lewd, wanton and lascivious conduct, both felonies, according to court documents.

Those charges were related to an incident similar to what occurred at the Walmart, but instead occurring at the Target parking lot on April 27, according to the police report.

When booked on April 27, he failed to post $100 cash and was detained at the Worcester House of Correction and summonsed to district court in May for arraignmen­t.

When arraigned, Dwyer, who pleaded not guilty, was ordered held in lieu of posting a $1,000 cash bail or $10,000 surety bond and ordered to stay away from the victim and Target, according to court documents.

However, he appealed the detention in Superior Court, which was granted, and was released.

For the charges out of Leominster, Dwyer will return to court on March 12 for a hearing.

For the charge out of Fitchburg, Dwyer will return to court on April 1 for a pretrial hearing, according to court documents.

Dwyer was also charged in March 2019 for open and gross lewdness out of Leominster. That single charge was eventually dismissed, according to court documents.
