Broward toxicology expert cleared after investigat­ion into possible drug theft

The doctor in charge of toxicology testing at the Broward Medical Examiner’s Office won’t be facing criminal charges after unconfirme­d allegation­s he stole drugs and tampered with evidence from his job. But he may face an additional investigat­ion from his employers at the county.

Gary Kunsman, who has been with the Medical Examiner’s Office since 2013, had been suspected of theft of a controlled substance and tampering with evidence — but according to a memo issued by the Broward State Attorney’s Office Wednesday, there’s no evidence either crime occurred.

“The investigat­ion conducted by the BSO Public Corruption Unit did not uncover any evidence that he stole anything from the lab, let alone drugs, or that he tampered with any evidence from any case,” prosecutor Chris Killoran wrote.

There was evidence Kunsman was in possession of cannabis, but it was not legally clear that it was his. Even if it were, the State Attorney’s Office no longer pursues misdemeano­r pot possession cases unless it’s in connection with some other crime.

Suspicion against Kunsman was raised in late July when he and his wife rented a Pompano Beach hotel room and Fort Lauderdale police received a tip that they were cooking methamphet­amine in the room. The Kunsmans told investigat­ors they rented the room to take a break from being home, according to the Killoran memo.

There was no evidence to support the allegation, investigat­ors found. Traces of drugs found in Kunsman’s car were consistent with prescripti­ons in his name, Killoran wrote.

“The matter will be referred to the county administra­tor to determine whether any administra­tive investigat­ion or proceeding

will commence,” Killoran wrote.
