Man gets prison time in meth-trafficking case
Another defendant accused of conspiring to traffic large quantities of methamphetamine from the Dallas area for distribution in the Mount Pleasant area in 2016 has been sentenced to time in prison.
Daniel Enrique Montes-Munoz, 37, appeared Monday for sentencing before U.S. District Judge Robert Schroeder III in Texarkana’s downtown federal building with an interpreter and Dallas lawyer John Helms. Montes-Munoz is listed in the indictment as defendant No. 2 and is among at least eight defendants named.
Neither the first, third or seventh defendants in the case have been arrested and the indictment remains sealed in the Texarkana Division of the Eastern District of Texas. However, the second, fourth, fifth, sixth and eighth defendants have been arrested, and all but one of them has pleaded guilty.
Montes-Munoz received a 97-month prison sentence and upon satisfaction of his term will be brought before immigration officials for possible deportation to his native Honduras, Schroeder ordered.
Assistant U.S. Attorney Jonathan Hornok said the conspiracy involved a large number of participants and a substantial amount of methamphetamine.
Helms said that Montes-Munoz was not a “high level” member of the conspiracy and was “not the one with the commercial vehicle.” A factual basis document filed in the case states that the conspirators trafficked “bulk methamphetamine” between 15 and 45 kilograms and that Montes-Munoz served as a distributor in the Mount Pleasant area. A $50,000 judgment was levied against Montes-Munoz and is meant to represent the proceeds of his illegal conduct.
Timothy Franklin Harper, 31, is listed as defendant four and was sentenced in December to more than 15 years in prison for his role in the conspiracy. Harper’s factual basis document states that he too served as a distributor of kilos of methamphetamine trafficked from Dallas for sale in the Mount Pleasant area. Harper must serve 188 months in federal prison and is responsible for a $50,000 money judgment.
Jason Wayne McLemore, 41, is listed as defendant five and was sentenced in February 2018 to a 151month federal prison term for his role in the conspiracy. A $100,000 judgment is ordered in McLemore’s case.
Collin Hayden, age unavailable, is listed as defendant six. Hayden is currently in the custody of U.S. Marshals and his case is scheduled for trial before Schroeder in April.
Gerald Clinton Davis, 47, is listed as defendant eight. Davis was sentenced to 10 years in federal prison for his role in the conspiracy in November. A $100,000 judgment is ordered in Davis’ case.
