A convicted felon who allegedly robbed a Waffle House at gunpoint was shot and killed Monday by officers attempting to serve an arrest warrant, the Cobb County Sheriff’s Office said.

Michael Wayne Smashey, 37, was killed at his home, in the 4800 block of West McEachern Woods Drive in Powder Springs, police said.

At 1:20 a.m. on Jan. 30, Smashey allegedly threatened an employee of a Waffle House on Mars Hill Road with a handgun before stealing approximately $300 from the register, according to Cobb County police.

“The accused reached into the open cash register and brandished a black pistol in a threatening manner,” Smashey’s arrest warrant stated.

The arrest warrant was issued for Smashey lat- er that day, charging him with armed robbery, aggravated assault and possession of a firearm by a convicted felon. But he was not arrested, according to Cobb jail records.

On Monday, deputies from Cobb and Paulding counties, along with U.S. Marshals, attempted to serve Smashey with the arrest warrant when he was shot around 3:50 p.m. No details were released regarding who shot the 6-foot-8, 285-pound Smashey or what led to it.

The GBI is investigating the incident.
