McIver out as executor over late wife’s estate
A Fulton County judge has removed Claud “Tex” McIver as executor over the estate of his late wife after prosecutors argued he likely murdered the Atlanta businesswoman for personal gain.
The Fulton County District Attorney’s office has charged McIver with malice murder in the shooting death of Diane McIver and petitioned the court to strip him of control of her money and assets. In a filing, the DA’s office said it believes Diane McIver had a second will and that the contents likely speak to his motive for killing her.
McIver’s lawyers have flatly denied that. “There is no second will,” Stephen Maples said. “There are no flying saucers and Bigfoot does not exist.”

Roswell mayor testifies in term limits trial
Roswell Mayor Jere Wood testified Monday in a case that questions his ability to remain in office.
Michael Litten, a Roswell resident, sued Wood last year claiming that the mayor had violated term limits that he had championed. Wood was elected to a fifth term in 2013.
In 2010, the Roswell city council passed an ordinance saying that the mayor would be limited to three consecutive terms.
Monday, Wood and city attorney David Davidson testified that the term limits weren’t supposed to be retroactive.
The case is being heard in Fulton County Superior Court by Judge Craig Schwall.

Jessica Colotl’s arrest on a traffic violation in 2010 sparked a controversy about “unauthorized” immigrants attending public colleges.
A Cobb judge had dismissed the criminal case stemming from the traffic charge. Her attorney called the federal government’s move this week “legally incorrect.”
