U.S. Rep. Steve Cohen, D-Memphis, issued the same concern in a short speech at the rally.
“This guy’s unbelievable,” Cohen said of Whitaker, citing a 2014 quote from Whitaker saying only Christians should be judges.
Cohen called Whitaker “the hatchet man” and said the legislature would take the administration to court if needed.
The Senate or Deputy Attorney General Rod Rosenstein, whom Trump bypassed by installing Whitaker, would have to initiate that action, Cohen said, but the House of Representatives would be ready to back them up.
“We will join with the senators that come forward,” Cohen said.
Democrats will have a majority in the house in January, their first chance to significantly halt Trump’s agenda.
