Fotis Dulos fails to show for deposition in mother-in-law’s civil lawsuit.

The attorneys for Jennifer Dulos’ mother are calling for sanctions against Fotis Dulos for failing to appear for a deposition this week.

Richard Weinstein, who is representi­ng Gloria Farber and her late husband’s estate, filed a motion on Wednesday requesting the court to enter a default against Fotis Dulos and his real estate developmen­t company, Fore Group.

“No protective order was filed,” Weinstein said of the deposition that was scheduled for Tuesday at his West Hartford office. “No request for continuanc­e was made.”

Farber has filed two civil lawsuits against Fotis Dulos, accusing him of failing to repay nearly $2 million in loans he used to purchase and develop homes for his company. Fotis Dulos has contended that the funds were gifts and were not expected to be paid back.

Weinstein said notice of Tuesday’s meeting was sent two weeks ago to Fotis Dulos’ attorneys, Kent Mawhinney and John Clifford. However, those attorneys filed notice with the court last month to be withdrawn from the case. Rich Rochlin, who is representi­ng Fotis Dulos in his divorce case, said Wednesday that they are seeking a new attorney to handle the civil lawsuits.

Weinstein previously filed a motion of default in September when he said Fotis Dulos and his attorneys also failed to appear for a deposition.

Fotis Dulos, 51, and his girlfriend, Michelle Troconis, 44, have been charged with tampering with evidence and hindering prosecutio­n in Jennifer Dulos’ May 24 disappeara­nce.

Farber has been caring for the five Dulos children since her daughter went missing. The 80-year-old New York City resident is also seeking legal custody of the children who are between the ages of 8 and 13.

Fotis Dulos has been banned from contacting his children as part of the conditions of his release on $500,000 bond.

Farber filed a motion to intervene in the divorce case June 3, saying she has a close relationsh­ip with the children and that Fotis Dulos had only been allowed to have supervised contact with them since March.

The motion also notes Fotis was barred from having any contact with the children at one point in 2018 after a judge found he violated court orders in the case and tried to get the children to lie for him.

Rochlin filed his own motion last month for Farber’s request to be thrown out. He cited a 2008 Connecticu­t Supreme Court case in which the court said a third party seeking visitation with a child against the wishes of a fit parent must spell out how the child would be neglected or uncared for if a judge were to reject the request.
