Death penalty up­held in sex-re­lated killing

The Mis­souri Supreme Court up­held Tues­day the death sen­tence given to Richard Davis for the video­taped sex­ual as­sault and murder of a woman at his In­de­pen­dence apart­ment. A jury con­victed him in 2008 for killing Mar­sha Spicer, whose body was found in a shal­low grave in Lafayette County.

Davis and his girl­friend, Dena Ri­ley, video­taped the 2006 as­sault. Ri­ley is serv­ing life in prison with­out pa­role.

“This crime was un­speak­able, Mr. Davis’ con­duct cold and cal­cu­lat­ing, and the ev­i­dence of guilt over­whelm­ing,” Judge Laura Den­vir Stith wrote.
