Man accused of abducting child deemed insane; case referral coming

The fate of a 30-yearold man accused of trying to abduct a 6-year-old boy will lie in the hands of state psychologi­sts after he pleaded not guilty by reason of insanity.

Luzjaie Captain’s entry of the plea was not opposed by Macomb prosecutor­s and was accepted last week by Judge Joseph Toia of Macomb County Circuit Court. The plea was based on a report by the state Center for Forensic Psychiatry, which is expected to issue another report on a plan of action within 60 days.

“He was found not guilty by reason of insanity by reason of insanity by the forensic center and we didn’t disagree with that evaluation,” said Assistant Macomb Prosecutor Stephanie Stager.

State psychologi­sts determined he was insane at the time of the incident.

The plea means he could be held for weeks, months or years, depending on evaluation­s by the Center and probate court, said his attorney, Joseph Kosmala.

Captain, who has prior conviction­s, had faced a sentence of up to life in prison if he was convicted of the main charge, kidnapping by enticement. He also was charged with resisting arrest.

“If he was convicted, he would be looking at many years in prison,” Kosmala, who has been in contact with Captain multiple times over the past 10 months while in custody at the county jail, offered.

“He’s been taking his medication­s and doing well,” he said. “It’s when he doesn’t take his medication­s is when he has problems.”

The incident occurred last May 24 on a Sunday afternoon in the area of Hubbard and North Highland streets in Mount Clemens, according to the Macomb County Sheriff’s Office.

A 19-year-old woman babysittin­g a neighbor’s children said Captain made overtures to her and squirted the children with water from a bottle, sheriff’s officials said. He complied with her request to leave but returned and tried to give juice to a 6– year-old boy, grabbed him by the arm and began walking away with him. The woman asked what he was doing, and Captain said he was going to give the boy candy, police said. The woman threatened to call police, and Captain released the boy.

Captain was next spotted by deputies outside of a vehicle with its hood up in a parking lot on Groesbeck Highway at North Rose Street, according to deputies.

When he noticed police, Captain quickly shut the hood and entered the vehicle, police said. He locked the vehicle doors and would not respond to deputies’ commands, police said.

Deputies forced entry into the vehicle and he was apprehende­d and charged.

A deputy cut his arm during the incident, police said.

Captain was the subject of a missing person report filed in Detroit in December 2019 and was again reported missing in May 2020, officials said.

According to Michigan Department of Correction­s records, Captain was sentenced in January 2018 in Macomb Circuit Court to 2-15 years in prison for resisting and obstructin­g arrest in July 2017. He was paroled in August 2019.

His criminal record also includes a conviction of fourth-degree criminal sexual conduct with an incapacita­ted victim in 2014. He was sentenced to two years behind bars.
