Man admits to filming female

A 23-year-old man who was previously determined to be a sexually delinquent person pleaded guilty to two felony charges for trying to film a female in a bathroom in an Eastpointe retail store, according to court records.

Michael Capizzo pleaded guilty to illicit filming of an unclothed person and using a computer (a telephone) to commit a crime last week in front of Judge Carl Marlinga in Macomb County Circuit Court.

Capizzo is scheduled to be sentenced May 19. The computer crime carries a maximum penalty of between four and 10 years, and the filming charge is punishable by up to five years in prison.

Capizzo was arrested last Dec. 7 after he was caught filming the female in a stall in the women’s bathroom at the Big Lots store at 10 Mile and Kelly roads. He fled the store upon being detected but was captured shortly afterward.

Capizzo pleaded guilty in exchange for Macomb prosecutor­s agreeing to drop second-habitual status against him, which would have increased his maximum penalty at sentencing.

His arrest also drew a probation violation charge against him for a case in which was convicted of gross indecency and stalking for a December 2018 incident in Roseville. In that case, he was sentenced by Marlinga to one year in the Macomb County Jail and five years probation. He was also declared a sexually delinquent person by Marlinga, increasing his maximum penalty of up to life and requiring him to register as a sex offender. A probation violation hearing is scheduled for the same day as the sentencing in the Eastpointe case.

Capizzo is currently held without bond in the county jail.
