Minors sue Arctic Sea Mining for injuries sustained in accident

Two teenagers who were injured in a car accident due to a steel cable strung across Port Road that flattened the cab of the truck they were riding in, are suing Arctic Sea Mining LLC alleging negligence and reckless indifferen­ce.

The incident occurred on Oct. 26, 2018 at Port Road. According to the lawsuit and reports given at the time by emergency personnel, an Arctic Sea Mining crew attempted to haul their gold dredge from the barge ramp to its winter location. Two steel cables were attached to the dredge on one end and a loader and a gravel truck on the other end. The dredge was on airbags and pulled out of the water. At one point, the cables were reaching across the roadway of Port Road. According to Nome Volunteer Fire and Ambulance Chief Jim West Jr., the Chevy truck hit the cable, traveling southbound on the road. The cable then smashed the windshield and bend the truck cab backwards. Photos taken by Nome police show emergency responders cutting off the cab to free the three trapped motorists, who sustained injuries in the accident.

Russ Winner and Myron Angstman are the lawyers for the plaintiffs. Angstman of Bethel said in a phone interview that there will be an amendment to the original lawsuit, adding a third person to the lawsuit, another minor, who was also riding in the truck at the time of the accident.

The lawsuit alleges that the defendant breached its duty to take reasonable steps to prevent injury to the motorists and suffered damages “in an amount proven at trial.”

The suit also seeks punitive damages as it alleges that “defendant’s conduct evidenced reckless indifferen­ce to the interests of plaintiffs.”

The plaintiffs seek damages in ex- cess of $100,000, punitive damages, and award of attorney’s fees.
