Ex-officer charged with domestic abuse

A former McLoud police officer accused of beating up his wife is facing two felony counts of domestic abuse.

Jose Antonio Diaz, 44, was charged Tuesday in Oklahoma County District Court. Prosecutor­s allege Diaz choked, shoved and punched his wife July 30 at the couple's Midwest City home.

Marian Diaz was standing in the driveway crying when police arrived about 10 p.m ., according to a court affidavit.

“I noticed her left eye was swollen and was red and purple,” an officer reported in the affidavit .“I immediatel­y asked Marian what happened and she told me that her husband had beat her up this evening after an argument over another guy.”

The woman also suffered injuries to her left and right arms and had “some severe redness around her neck area,” the officer reported. She said her husband confronted her about an affair and wanted her phone, police said.

Marian Diaz told police her husband choked her in the living room and pushed her all the way to the back bedroom where he pinned her on the ground.

“Marian said she could barely breath and was about to pass out when Jose punched her in the eye,” the officer reported.

Diaz told police he didn't know how his wife got the injury to her eye but admitted that they were fighting inside the house because he found out “Marian was having an affair and still talking to the guy.”

“Jose said that he was attacked by Marian and was only trying to push her away ,” the officer reported.

At the time of his arrest, Midwest City Police Chief Brandon Clabes said Diaz violated an oath to uphold the law by “committing domestic violence against his wife.”

“Some people feel law enforcemen­t is treated differentl­y but justice is blind and Mr. Diaz will be held accountabl­e for his actions in Midwest City, regardless if he is a police officer or not,” Clabes said in a news release.

Diaz was terminated July 31, McLoud Police Chief Wes Elliott said Tuesday.
