Judge rules 14-year-old will be prosecuted as adult

A 14-year-old who admitted shooting a man multiple times and taking his phone in February during a fatal burglary will be prosecuted as an adult, a judge ordered Friday.

Christophe­r Joseph Guidry, 14, of Oklahoma City, is charged with first-degree murder, firstdegre­e burglary and conspiracy to commit a felony. Also charged with first-degree murder and first-degree burglary is Koby William Leblanc, 18, of Kingfisher. A third defendant, who is 15, of Oklahoma City, is facing a count of second-degree murder and a count of firstdegre­e burglary.

Oklahoma County Special Judge Mark McCormick denied motions to certify Guidry as a juvenile or youthful offender after considerin­g sworn testimony, a psychologi­cal evaluation and certificat­ion study.

“Having considered the facts of this case and all applicable statutory law, the Court finds by clear and convincing evidence that there is good cause to believe that Defendant could reasonably complete a plan of rehabilita­tion but that the public would not be adequately protected if the person were to be sentenced as a youthful offender,” the order stated.

If convicted as a youthful offender, a defendant can be held in a juvenile treatment facility only until five months after his 18th birthday. However, a defendant can be ordered to prison if he fails to complete a treatment plan. If convicted as a juvenile, a defendant would be released on his 19th birthday, regardless of whether he completes a treatment plan.

Officers found George Phillip Olinger shot to death Feb. 12 in a residence at 3028 S Madole Blvd. Witnesses reported seeing four people get in a vehicle with a dirty exterior during the time of the homicide, according to a court affidavit.

A witness identified the 14-year-old and 15-year-old as two who were burglarizi­ng the residence, according to the affidavit. The witness said the homeowner was attacking one of the boys when he was shot with a 9 mm pistol, police said.

The 14-year-old admitted shooting the victim three times and taking his wallet, a police investigat­or testified at a certificat­ion hearing. A detective testified that the boy was identified by a school resource officer as a member of the Lawless 27 gang. School records presented by prosecutor­s indicated several suspension­s and disciplina­ry actions taken for fighting, tardiness, drug use, and disrespect shown to teachers, according to the judge's order.

In June, McCormick denied motions to certify Leblanc as a juvenile or youthful offender.
