Two brothers arrested in relation to the killing of third brother

Annsville, N.Y. — On Sept. 17, at approximat­ely 12:13 p.m., State Police responded to a reported shooting incident that occurred inside a residence at 3664 State Route 69 in the town of Annsville, Oneida County.

Investigat­ors say, two brothers, 27-year-old Matthew E. Westcott and 30-year-old James E. Westcott, who both live at the residence, had a verbal argument. After the argument, Matthew shot James with a shotgun, authoritie­s say.

The brother’s father, Edward Westcott, heard the gunshot and immediatel­y called 911.

When troopers arrived on the scene, they placed Matthew into custody without incident.

James Westcott was transporte­d by ambulance to Rome Memorial Hospital where he was pronounced deceased from a gunshot wound to the face.

Matthew Westcott was arrested and charged with Murder 2nd degree, a class “A” felony, and Criminal Possession of a Weapon 3rd degree (convicted felon), a class “D” felony.

State Police were assisted at the scene by the Oneida County District Attorney’s Office, Taberg Fire Department, and Amcare Ambulance Services.

On Sept. 18, State Police arrested another brother, Michael E. Westcott, 31, for Assault 1st degree, a class “B” felony. Michael is accused of stabbing his brother James after the shooting.
