- By Jamie Fleury Staff Writer

The Culver Town Council approved Ordinance 2022-003 -Rezone 415 Lake Shore Drive from Commercial to Planning Unit Development (PUD) on first read during the meeting Tuesday. The Culver Plan Commission favorably recommended the rezone after a public hearing and meeting held last month.

During public comment, attorney Stephen R. Snyder of Snyder Morgan Federoff & Kuchmay LLP advised the council that he had filed a petition on Monday in Marshall County Circuit Court Judge Curtis Palmer's Court for a judicial review of the determination made by the Plan Commission.

Snyder represents cli

ents Doug Farmer, Bob Darovic, Matt Nagel, Jeff Mansfield. Snyder advised the council that the ordinance was defective for several reasons. Member Rich West recused himself from the vote to avoid conflict of interest. Other members voted in approval of the ordinance on first read. The item will be on the agenda for the May 24 meeting for second read.

In other news the council approved the request presented by President of Culver Lake Fest Committee andrea Canacci for the event and for a special request for a beer garden on Friday evening; both pending the approval of Culver Police Chief Wayne Bean and that other local and state compliance measures be met.

The Culver Lake Fest will be held the weekend of July 15, 16 and 17. Canacci emphasized the desire of the committee to offer an opportunity for non-profits, organizations, and the schools to benefit from the festival. The Culver Cavaliers Football team will be “tackling trash” during the festival for a donation by the committee in support of the team. Three on Three Basketball will resume this year along with a hot dog eating contest and a Bass Fishing Tournament.

The theme for this year’s festival is “art is in the air” and will include musicians, painters and a magician.
