within two calendar days of bid opening will not be answered. Bids shall be properly and completely executed on the bid proposal form provided, accompanied by a Non-collusion Affidavit and a Certified Check or Bid Bond payable to the Owner in the amount of not less than five percent (5) of the bid. Each bid shall include a Non-discrimination Commitment and all other required forms as described in the bidding documents.

The bidder awarded the contract will be required to furnish

a separate Performance Bond and Payment Bond, each in the amount of one hundred and twenty five percent (125%) of the contract price before commencing work. The Performance Bond and Payment Bond shall remain in effect throughout the entire construction period. In addition, a Maintenance Bond in the amount of ten (10%) percent will be required for a period of three (3) years from the date of Final Acceptance.

The Town Council of the Town of Argos, Indiana, reserves the right to reject any and all bids or to waive any irregularities in bidding, to accept a full or partial award of the Bid or Bids

which, in its judgement, will be in the best interest of the Town of Argos.
