Co­hoes man faces 50 years in prison for rap­ing child

AL­BANY, N.Y. >> A 39-year- old Co­hoes man faces 50 years in prison af­ter he was found guilty in a child rape case, ac­cord­ing to Al­bany County Dis­tinct At­tor­ney David Soares.

Soares re­cently an­nounced that Der­rick Rosa, 39, of Co­hoe s , wa s found guilty af­ter a jury trial of one count of first­de­gree crim­i­nal sex­ual act, a Class B Felony, one count of sec­ond- de­gree crim­i­nal sex­ual act, a Class D Felony, two counts of first-de­gree rape, each Class B Felonies, one count of sec­ond- de­gree Rape, a Class D Felony, one count of third- de­gree rape, a Class E Felony, and two counts of en­dan­ger­ing the wel­fare of a child, each Class A Mis­de­meanors, be­fore the Honor­able Wil­liam A. Carter in Al­bany County Court this af­ter­noon.

Af­ter de­lib­er­a­tion and re­view of the pre­sented ev­i­dence dur­ing the trial, Soares said that the jury found that on an evening be­tween Oc­to­ber 9, 2014 and Oc­to­ber 31, 2014, Rosa en­gaged in forcible oral sex­ual con­duct with a child who was 14 years old at the time.

Be­tween Nov. 27, 2014 and Dec. 25, 2014, author­i­ties said Rosa en­gaged in forcible sex­ual in­ter­course with the same child. This con­duct con­tin­ued with the child un­til the fi­nal act of sex­ual in­ter­course oc­curred on Aug. 22, 2017, again by forcible com­pul­sion, when she was now 16 years old.

Over the afore­men­tioned pe­riod of time Soares said that Rosa en­gaged in mul­ti­ple acts of phys­i­cal abuse against the child as well.

In ad­di­tion, Soares said that Rosa did know­ingly act in a man­ner likely to be harm­ful to the phys­i­cal, men­tal, or moral wel­fare of an ad­di­tional child in the home dur­ing the same time pe­riod.

Rosa faces 50 years in State Prison when sen­tenced on Fe­bru­ary 8, 2019.

As­sis­tant Dis­trict At­tor­ney Jen­nifer McCan­ney of the Spe­cial Vic­tims Unit is han­dling the pros­e­cu­tion of this case.
