Another man sentenced to prison for role in 2016 Troy homicide
TROY, N.Y. » Another man was sentenced to state prison for his role in a 2016 homicide.
State Supreme Court Justice Honorable Andrew G. Ceresia recently sentenced Magdaleno Perez- Calixto to nine years in state prison and five years of post-release supervision, based on a previous plea of guilty to second- degree kidnapping, a Class B violent felony, and second-degree burglary, a Class C violent felony, for his involvement in the deaths of Christian Gonzalez-Hernandez and Javier Gomez Bartolon.
Last week, Ceresia sentenced Luis Monge Guevara to 25 years to life on Guevara’s conviction of second- degree murder and 15 years on the charge of second- degree burglary for his involvement in the same incident.
The incident occurred in Bar
tolon’s apartment on October 17, 2016.
A third co- defendant, Salomon Najera Hernandez, was sentenced to five years in state prison after a plea of guilty to the charge of second- degree burglary for his involvement in the incident.
The case was prosecuted by ADA Andrew Botts.
Rensselaer County District Attorney Mary Pat Donnelly appeared at sentencing, along with Chief ADA Matt Hauf.
Calixto urged Ceresia to amend the agreed-upon sentence, which Donnelly opposed.
“This sentencing concludes an almost threeyear prosecution undertaken to bring justice to Javier Gomez Bartolon. Based upon the complicated history of this case, our office is pleased with the resolution,” Donnelly said in a news release
