City negotiates settlement with apartments developer

The city of Vacaville has successful­ly negotiated a settlement with the developer of the proposed Southtown Apartments project.

The intent of the developer was to construct 236 multi-family apartments units on a vacant 9.91-acre site at the northwest corner of Leisure Town Road and Redstone Parkway.

While the City Council is aware of the community's concerns about the new developmen­t, officials said the Council is also aware of the need for housing, especially military housing.

The city has taken action to end the litigation due to the expense of defending the current lawsuit and in compliance with SB 330, the Housing Accountabi­lity Act.

The developer, T.A. Leisure Town LLC, revised the parking plan for the project. Due to neighbors' concerns, the use of on-street parking has been reduced by almost half with the addition of onsite parking.

“The settlement requires the City Council to conduct a public hearing on the project applicatio­n with these revisions in March 2023,” said a city press release. “If the City Council approves the Project at the public hearing, the developer will immediatel­y dismiss the litigation. If the City Council either elects not to hear the

Project or denies the revised Project, the pending litigation will continue. If the City Council chooses to litigate, it is anticipate­d that the City would face total expense and exposure in the seven-figure range.”

At Tuesday's City Council meeting, the Council began the process by scheduling a public hearing for reconsider­ation of the revised Project for March 14.

The Council denied the project Nov. 15.

T.A. Leisure Town v City of Vacaville and Vacaville City Council was filed in Solano County Superior Court on Dec. 10.

City Council closed sessions regarding the T.A. Leisure Town litigation took place Jan. 10, Jan. 24 and Feb. 7.
