Prelim unsettled in market owner death
A preliminary hearing date still remains undetermined for a 22-yearold Solano man who has pleaded not guilty in Solano County Superior Court to charges of fatally shooting a Benicia market owner and to a series of alleged robberies prior to the March 8, 2022, killing.
Judge Robert Bowers ordered Nyzell Marquis Dubuisson, who appeared Monday in Department 15, to return for a rescheduled hearing setting and a readiness conference at 9 a.m. June 5 in the Justice Building in Vallejo. Dubuisson is represented by criminal defense attorney Vincent Maher.
Court records show that in March 2022, Chief Deputy District Attorney Bruce Flynn, who filed the original criminal complaint, submitted an amended complaint to include 17 counts of second-degree robbery and two more counts of assault with a firearm in connection to the string of robberies, alleged crimes dating from Jan. 24 to March 5, 2022, in Solano County.
Dubuisson faces one count of first-degree murder, with special circumstances, and two counts of robbery in connection to the gunshot slaying of Bahadur Singh, 60, who had owned and worked at the Rose Market for 21 years.
Jail records show that Dubuisson apparently eluded law enforcement for several days after the shooting, but Benicia police officers finally arrested him March 11 in the 3600 block of Broadway.
In a press release issued at the time, Solano County District Attorney Krishna Abrams said Singh has been described “as one of the most kind, generous and hard-working men in our community.” She promised to hold those responsible for his death “to the fullest extent of the law.”
As part of the prepared statement, Benicia Chief of Police Mike Greene added, “Mr. Singh's death is a huge loss to our community and he will be sadly missed.”
The murder charge with special circumstances — in this case, a murder committed during a robbery — means Dubuisson if found guilty at trial, could face life without the possibility of parole or the death penalty, which is still on the books in California. However, since March 2019, a moratorium issued by Gov. Gavin Newsom has halted capital punishment in the Golden State.
Dubuisson remains without bail in the Stanton Correctional Facility in Fairfield.
