Alleged fight over gun leads to two arrests
A Hot Springs man and Jessieville man were both arrested late Wednesday after allegedly fighting over a firearm at a local gas station.
Davis Clayton Graves, 38, who lists a Highway 298 address, and Chance Donel Neighbors, 26, of Jessieville, were taken into custody shortly after 10:30 p.m. Graves was charged with aggravated assault, a felony punishable by up to six years in prison. Neighbors was charged with misdemeanor counts of third-degree battery, punishable by up to one year in jail, and public intoxication, punishable by up to 30 days.
Graves remained in custody Thursday in lieu of $2,500 bond while Neighbors bonded out. They are set to appear June 6 in Garland County District Court.
According to the affidavit, at approximately 9:45 p.m., Garland County sheriff’s Deputy Charles DeLaHunt responded to Top of the Mountain Shell, 4401 Highway 7 north, in reference to a male with a firearm and made contact with Neighbors, who said Graves had pulled up to speak with him at the store.
The two men got into an altercation, during which Graves allegedly pulled out a 12-gauge shotgun, pointed it at Neighbors and threatened that he would “blow his head off.” Neighbors said he wrestled the shotgun from Graves and gave it to the store clerk. Graves then fled from the scene, but was brought back by an Arkansas State Police trooper.
Surveillance footage reportedly showed Graves pulled up to a gas pump and Neighbors approached the driver’s side door. Neighbors began throwing punches at Graves and a fight over the gun ensued.
Graves stated that Neighbors came to the window “talking crap” and was intoxicated. Neighbors allegedly hit him in the head and tried to reach for the shotgun. He retrieved the gun and took it inside the store.
DeLaHunt noted he smelled an odor of intoxicants coming from Neighbors and both men were taken into custody.
