A Mountain Pine man sought by Hot Springs police after he broke into another man’s house late Monday was reportedly found lying on the side of the street.

Robert Benjamin See, 22, who lists a Mountain Pine Road address, was taken into custody shortly after 11 p.m. and charged with a felony count of residential burglary, punishable by up to 20 years in prison, and misdemeanor counts of first-degree criminal mischief and public intoxication.

See, who also had a warrant for a probation violation, was being held on $6,500 bond and is set to appear today in Garland County District Court.

According to the probable cause affidavit, around 10:45 p.m. Monday, police officers responded to a burglary in progress and once they arrived in the 300 block of Golf Links Road they spotted a white male matching the description of the alleged burglar lying on the side of the road.

They made contact with the man, later identified as See, and noted his speech was slurred and he had watery, bloodshot eyes and was unsteady on his feet.

They made contact with the homeowner of the residence involved who stated he came home around 10:30 p.m. and saw a window of his residence had been broken out. Upon entering the house, he saw a man lying on his living room floor. The man got up and left on foot headed toward Golf Links Road.

While officers detained See, the homeowner looked at him and positively identified him as the man in his house.

See had pleaded no contest on May 9 in district court to a charge of criminal trespass involving National Park Medical Center, 1910 Malvern Ave., and was sentenced to 90 days in jail with all but 27 days suspended. He was given credit for time served since his arrest April 13 and released.
