Lower Moreland man draws prison for sexual assault of underage girl

NORRISTOWN >> A Lower Moreland man was sent to prison after he admitted to sexually assaulting an underage girl in the township.

Tabias Javah Davis-Diaz, 22, of the 3700 block of Pine Road in the Huntingdon Valley section of the township, was sentenced in Montgomery County Court to 2 to 10 years in a state correction­al facility after he pleaded guilty to charges of statutory sexual assault, indecent assault of a person under 16 years of age and corruption of a minor in connection with incidents that occurred in September 2020.

At the time of the incidents, the girl was 13 and Davis-Diaz was 20, according to court papers.

Judge Risa Vetri Ferman also ordered Davis-Diaz to complete five years’ probation following parole, meaning Davis-Diaz will be under court supervisio­n for 15 years.

The judge said Davis-Diaz must comply with all recommenda­tions for treatment after a psychosexu­al evaluation and must complete a sex offender treatment program while incarcerat­ed. Upon release from prison, Davis-Diaz must participat­e in a community-based sex offender treatment program as directed by the state Board of Probation and Parole.

Davis-Diaz is prohibited from having contact with the victim and her family and is prohibited from having unsupervis­ed contact with minors. Davis-Diaz also must cooperate with a full disclosure polygraph examinatio­n to help his treatment team develop an appropriat­e and comprehens­ive treatment program, the judge said.

Davis-Diaz also faces a 25-year requiremen­t to report his address to state police in order to comply with Pennsylvan­ia’s Sexual Offender Registrati­on and Notificati­on Act.

An investigat­ion began on Oct. 1, 2020, when Lower Moreland police received a report of sexual contact between Davis-Diaz and the underage girl who was visiting the area from another state and who knew Davis-Diaz’s family, according to the criminal complaint.

The girl told investigat­ors that Davis-Diaz had sexual contact with her on two occasions while she was in the company of Davis-Diaz, according to the criminal complaint filed by Lower Moreland detectives.

Other charges of involuntar­y deviate sexual intercours­e of a child and aggravated indecent assault of a child were dismissed against Davis-Diaz.
