Defense attorney: Claims of sex assault are fabricated
TRENTON >> A convicted felon is accused of forcing a young girl into performing oral sex on him, prosecutors said.
Jamar Burgess, 35, said at a bail hearing Tuesday that’s not true.
His attorney contends the allegations cropped up because his accuser’s mother is a horrible parent, and he planned to tell child welfare officials about her woeful neglect.
Public defender Kathleen Redpath-Perez said the accuser’s mother threatened to do something to her client, even tried to hit him with a hammer, if he called the Department of Child Protection and Permanency on her for being an unfit mother.
Next thing he knew it, he found himself charged with counts of sexual assault and endangering the welfare of a child, for allegedly forcing himself on a 7-year-old girl in June.
“That’s where these allegations came out of,” Redpath-Perez said.
Prosecutors called the girl’s allegations a “delayed disclosure.”
Burgess, who is also charged in another case with stalking and terroristic threats, was arrested by the fugitive task force this month on the sex assault allegations.
In the threats case, he is accused of calling a woman night and day and sending her harassing text messages.
Prosecutors said the woman contends it had been going on since September 2015.
In one of the messages, Burgess allegedly threatened to off the woman’s mother. He wrote it only took $6,500 to push a b---,” prosecutors said.
He also allegedly warned the victim not to sleep by the window, told her he would “redecorate that bedroom with blood spatter,” and left creepy voicemails on her phone.
Burgess’ attorney said it’s possible someone could have been “spoofing” the woman’s phone as part of a complex cyber attack. Spoofers often use online apps to hide caller information.
However, the woman said she knew for certain that Burgess showed up unexpected at her home one time, prosecutors said, banging on the doors and ringing the doorbell for 50 minutes.
Prosecutors did not say whether the victim in the threats case is the mother of 7-year-old who accused Burgess of sexual assault.
Burgess has a multistate rap sheet. He has been arrested a dozen times, ending in four convictions for crimes such as forgery and theft by deception.
He is being held at the county jail on a combined bail of $70,000.
