Lawsuit: Negligence caused pipe worker’s injuries

A Ewing man is suing Hamilton Township on allegations he suffered “disfiguring injuries to the right side of his body” while performing contracted repair work at Hamilton’s wastewater treatment plant.
Christopher M. Lojko accuses the township of negligence, alleging the township did not provide him with “reasonable and proper assistance” when he attempted to unload pipes at the Water Pollution Control facility at 300 Hobson Ave. two years ago.
The incident occurred on March 28, 2019, when Lojko, then an employee of Ted Dolci Inc., suffered an amputated right thumb and other permanent injuries while unloading pipes from a truck onto the WPC premises, according to a civil-action complaint he filed in Mercer County Superior Court last month.
Lojko is demanding a trial by jury, compensatory damages and any other relief the court deems “just and equitable.”
Trial attorney Michael R. Paglione filed the active personal injury lawsuit on behalf of plaintiff Lojko. The complaint, dated March 22, says the alleged “negligence” of Hamilton Township caused the plaintiff to suffer from “severe and disabling injuries” depriving him of “normal pursuits” in the future.
Hamilton’s contract with Ted Dolci Inc. was in effect at the time of the alleged incident, records show.
Hamilton Township and the WPC facility “negligently failed to provide adequate, necessary, and functioning machinery to enable Plaintiff to safely and reasonably perform the work,” according to the allegations in Lojko’s complaint.
Ted Dolci Inc., also known as TDI, is a Hamilton-based pipe utility construction company specializing in the repair and installation of underground water and sewer services, according to its website.
Hamilton Council in November 2016 awarded a $1.2 million shared contract to Ted Dolci Inc. and other firms to conduct emergency underground infrastructure repairs at the WPC facility. The council in 2018 boosted the multi-year contract by $216,000 due to an “unanticipated higher amount of repair.”
Hamilton Township generally does not comment on active litigation, and Mayor Jeff Martin’s administration had no comment for this story.
