Redstone lawsuit by ex-girlfriend to proceed
A lawsuit filed by Sumner Redstone’s former girlfriend, who’s seeking to be restored as the health care agent of the media mogul, can proceed, a judge in Los Angeles ruled Monday.
Redstone, the 92-year-old former chairman of Viacom and CBS Corp., removed Manuela Herzer from his will last year, prompting her to file a lawsuit that challenged his mental competency to make such decisions.
Redstone’s lawyer filed a motion to dismiss the case, arguing that Herzer was financially motivated. In dismissing the motion, Los Angeles Superior Court Judge David Cowan set a trial date for May 6.
“Surviving a motion to dismiss is a far cry from winning her petition,” Gabrielle Vidal, an attorney at Loeb & Loeb, who’s representing Redstone, said in a statement. “This decision is not a finding on the merits, and it does not change the fact that Ms. Herzer’s motives are purely financial. We are confident that when the court has evaluated the evidence, it will determine that Mr. Redstone had capacity to change his health care directive and that Ms. Herzer should have no role in his life whatsoever.”
Herzer’s lawyer, Pierce O’Donnell, has said that Herzer wants to care for Redstone and that “this case has never been about money,” according to The Hollywood Reporter.
