Florida judge seals Kraft video in sex spa case for now
Footage of Robert Kraft’s visit to a Florida massage parlor won’t be released — at least outside a potential leak — until after the Patriots owner’s trial is underway or the case is otherwise adjudicated, a judge ruled Tuesday.
Palm Beach County Judge Leonard Hanser granted the protective order sought by Kraft’s legal team and wrote in his 10-page decision that “making these images public, at this time, seriously jeopardizes Defendant’s fundamental right to a fair and impartial jury.”
Hours after Hanser’s ruling, there was an emergency hearing in another court on the potential leak of the Kraft video. It was reported last week by the gossip website The Blast that the footage of an unclothed Kraft inside a massage room at the Orchids of Asia Day Spa in Jupiter was shopped to various outlets.
Circuit Judge Joseph Marx declined to issue sanctions against the State Attorney or the Jupiter police because “there’s not enough” evidence to determine the video has been leaked and, if it was, the source of the leak.
“If the video has really been leaked, people are going to see it,” Marx said. “Somebody is going to to buy it. I don’t think there’s anything I can do to stop that.”
Alex Spiro, one of Kraft’s attorneys, testified that there’s enough information that the video might have been leaked and the leak involved somebody with an AT&T mobile phone.
Marx did allow subpoenas to be issued to The Blast and AT&T and asked the agencies that have the video — Jupiter police and the State Attorney — to examine the security of their servers.
Kraft has pleaded not guilty to two misdemeanor solicitation charges and asked for a jury trial.
