Decree approved to adjust maritime management ops
HÀ NỘI Deputy Prime Minister Trần Hồng Hà has approved the Ministry of Transport's proposal on amending and supplementing some articles of Decree 58/2017/NĐ-CP.
Accordingly, the ministry will compile a decree amending the Government's Decree 58 detailing some articles on management of maritime activities at Việt Nam's Maritime Law.
The ministry will coordinate with relevant ministries and agencies to develop the new decree according to current legal documents and submit it to the Government in August 2024.
They will carefully evaluate the impact of regulatory policies on the management of submersibles and fixed transport routes for foreign shipping companies providing goods transportation services in Việt Nam.
According to the Ministry of Transport, the Government's Decree 58 dated May 10, 2017 has been effective in management of marine transport activities, especially the reform of administrative procedures for ships entering and leaving seaports. It is also an important legal basis for building and implementing the national single window mechanism for ships entering and leaving seaports.
However, after more than six years of implementation, there are some problems and inadequacies arising from practice and also the decree itself that need to be amended and supplemented. The adjustment will ensure consistency between legal documents and practical requirements, improving efficiency in State management for those marine transport activities.
Specifically, those issues needing review are ordering of maritime safety services, notices to mariners and temporary seaport infrastructure.
In addition, the Minister of Transport in 2022 approved a project to develop Việt Nam's shipping fleet. To implement this project, it is necessary to amend regulations on using tugboats supporting inland waterway vehicles in Decree 58 to increase transport productivity.
To implement the amended Electronic Transactions Law in 2023, regulations relating to implementing electronic procedures for ships need to be amended and supplemented.
The new decree also needs to supplement the responsibilities of State management agencies in building specialised databases to ensure the implementation of online administrative procedures.
