Court dismisses Nchito’s case
THE Lusaka Magistrates’ Court yesterday dismissed a case in which lawyer Nchima Nchito was accused of impersonation.
This matter came up yesterday before Magistrate Humphrey Chitalu for the withdrawal of the matter by Mr Abel Mboozi, the complainant.
However, Mboozi and his lawyer, Mr Osborne Ngoma were not present in the Lusaka Magistrates’ Court to withdraw theim personation case against Mr Nchima Nchito.
And after several notices issued to the court to attend court, the accused absented himself and this caused the court to dismiss the matter in his absence.
In previous matters, the court had ordered that Mr Mboozi be present in court to hear the application to withdraw the complaint which he had filed last year.
Magistrate Chitalu dismissed the matter stating that it was dismissed due to none appearance of the complainant after several notices being issued for him to attend court.
“The complainant having failed to appear after several notices, this case is dismissed due to none appearance of the complainant,” he said.
It is alleged that Nchito between November 1, 2016 and February 2017 at
Lusaka with intent to defraud filed court process in the High Court with cause number 2017/HPC/0059 thereby falsely representing himself as an advocate genuinely appointed by the Post Newspapers Limited (in liquidation).
Meanwhile in another case, seven men alleged to have stolen medicines at Medical Stores Limited were yesterday rearrested after their case was discharged.
This matter came up yesterday before Magistrate Greenwell Malumani for continuation of trial.
Magistrate Malumani discharged them stating that he had no control over the discharge as it was not an acquittal.
However, immediately they exited the court room, the seven were re-arrested on the same charge.
