Court rejects Nkombo, Kambwili bid to halt impeachment case
In this matter, Mr Robert Chabinga and Mr Henry Mulenga applied for Judicial Review over the Speaker's decision to table in Parliament the impeachment motion.
Mr Kambwili and Mr Nkombo had wanted to be joined to the case but the court refused on grounds that they had no standing in the matter.
The two then appealed to the Court of Appeal and asked the High Court to halt proceedings pending determination of their appeal.
But Lusaka High Court Judge Banda Bobo yesterday dismissed their application for stay, reiterating that they were not parties to the main matter and therefore have no standing.
“Based on the earlier ruling that the intended joinders were not vested with sufficient interest and therefore cannot be joined.
"The intended joinders would like to move the court to halt proceedings even though they are not party. There is nowhere where they have pointed which allows such a situation. I therefore dismiss the application with costs," Judge Bobo said.
Earlier during their arguments, movers of the motion, Mr Nkombo, UPND whip, and PF Roan MP Mr Kambwili, being the seconder, argued that the court had jurisdiction to grant reliefs to nonparties in Judicial Review.
The two parliamentarians contended that they stand to be affected by the outcome of the Judicial Review as their appeal stand to be rendered academic and as such they have to be allowed to intervene in proceedings despite not being joined as parties.
