Declare Roan seat vacant, Speaker told

WE request your good office to declare the Roan parliament­ary seat vacant since the High Court has dismissed a case in which Chishimba Kambwili was challengin­g his expulsion from the party, PF secretary-general Davies Mwila has implored Speaker of the National Assembly. And Mr Mwila says adverts calling for eligible party members intending to stand in Roan to apply for adoption will start running today as the ruling party was ready to battle it out with Mr Kambwili with victory ascertaine­d. In a letter dated October 26, 2018, addressed to the Speaker of the National Assembly, the PF called for a by-election in Roan. And addressing a horde of cadres who thronged the party secretaria­t yesterday to press the party to ensure that by-elections are held in Roan and Bahati constituen­cies, Mr Mwila said Mr. Kambwili was a done deal and that his fellow rebel Harry Kalaba would be the next to be crushed. “He (Mr. Kambwili) lost the case and what that means is that we have to go for a by-election. As a party, we are ready and I want to say that if he is man enough, he should not appeal but prove his popularity. Let him show his mantle. Next, we are going to deal with Bahati MP Harry Kalaba. “As a party, we are very much ready for the Roan by-election and I want to inform the nation that tomorrow (today), we will start advertisin­g and call for applicatio­ns from all those who want to apply to stand on our party ticket to do so. All those who want to stand in Roan are free to apply and come rainfall or sunshine, we are going to win,” Mr Mwila said. Meanwhile, Mr Kambwili has appealed his case to the Court of Appeal advancing three grounds in his memorandum of appeal. “The court below erred in both law and fact by failing to recognise the applicant’s actions, after its ruling dated 5th July 2018 as proof of the applicants prosecutio­n of his case. The court below erred in both law and fact by failing to recognise that the law dully provides for the varying of orders of directions after the same have been issued. “The court below misdirecte­d itself in law and fact when it absolved the respondent­s breach for orders while penalising the appellants alleged breach of the same,” read Mr Kambwili’s memorandum of appeal.
