KAMBWILI PF BID TOSSED OUT

...Court of Appeal dismisses matter with costs

Chishimba Kambwili has again lost his bid to cling on to the ruling Patriotic Front (PF) after the Court of Appeal yesterday threw out his appeal with costs.

This was after the former Roan Constituen­cy Lawmaker failed to avail the court with the record of appeal.

When the matter came up before Court of Appeal Judge Catherine Makungu, the matter was dismissed with costs.

In this matter Mr. Kambwili appealed the High Court’s decision to dismiss his case where he was challengin­g his expulsion from the PF.

The court dismissed the matter because he failed to obey the court’s orders for directions. High Court Judge Maria Kawimbe dismissed Mr Kambwili’s applicatio­n, saying it appeared that he was not serious with proceeding­s in the matter.

Mr Kambwili then went to the Court of Appeal seeking a declaratio­n that he should have been heard.

In July 2017 Mr. Kambwili sued the

PF seeking a declaratio­n order that the decision of the party’s central committee to expel him was illegal, wrongful, null and void.

He cited PF secretary general Davies Mwila as the defendant in the matter.

Mr Kambwili wanted the court to declare that his rights under the PF constituti­on were infringed upon because he was not given an opportunit­y to answer to the charges before a decision to expel him was arrived at. Mr Mwila, however, in his defence, had urged the court to uphold Kambwili’s expulsion on grounds that he caused his own expulsion through his conduct.

Meanwhile, counsel for the PF Milingo Lungu said he would follow up costs once the court avails him a formal letter of demand.

Last week there was jubilation in the PF ranks of Parliament after Speaker of the House Patrick Matibini declared Mr Kambwili’s seat vacant, paving the way for a by- election.
